By Representative Conroy of Wayland and Senator Fargo, a joint petition (accompanied by bill, House, No. 3531) of Thomas P. Conroy (by vote of the town) that the town of Lincoln be authorized to place a ballot question before the voters relative to changing an existing license for the sale of wines and malt beverages to be drunk on the premises to a license for the sale of all alcoholic beverages to be drunk on the premises.  Consumer Protection and Professional Licensure.  [Local Approval Received.]

An Act authorizing the town of Lincoln to place a certain question relative to the sale of all alcoholic beverages on the town's election ballot.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1.  Chapter 349 of the Acts of 2006 entitled, "An Act Authorizing the Town of Lincoln to Grant a License for the Sale of Wines and Malt Beverages to be Drunk on the Premises" shall hereby be amended by deleting in section 1 of said act the words, "wine and malt beverages" and inserting in place thereof the following:- all alcoholic beverages. 

Section 2. Notwithstanding any limitations imposed by Section 11 of chapter 138 of the General Laws as to the time and manner of voting on the question or section 17 of said chapter 138 relative to the number of such licenses authorized to be held, or any other general or special law to the contrary, the Board of Selectmen of the town of Lincoln shall cause to be placed on the official ballot at a regular or special town election or regular state election, provided that notice is given to the secretary of the commonwealth at least 60 days prior to the date of such state election, in the form of the following question:

"Shall an act passed by the General Court in the year 2011 entitled 'An Act Authorizing the Town of Lincoln to grant a single license to pour full alcoholic beverages to be consumed on the premises', be accepted?"

The Town shall include below the ballot question a fair and concise summary of this act. 

If a majority of the votes cast in answer to said question is in the affirmative, the town shall be taken to have amended chapter 349 of the Acts of 2006 and authorized the issuance of one license for the sale of all alcoholic beverages.  Said license shall be subject, however, to all other provisions of said chapter 138. 

Section 3. This act shall take effect upon passage.
