Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Section 13 of chapter 70 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by adding the following subsection:—
(f) In any fiscal year, if the amount appropriated is less than the amount of unrestricted general government aid in the previous fiscal year, it shall not be reduced to an amount below the sum of the municipality’s lottery and additional assistance local aid as appropriated in fiscal year 2002. If there is an appropriation to any municipality below this sum, the commonwealth shall defend, indemnify and hold harmless the municipality from all claims by third parties which may arise out of the result of this reduction in aid.
