An Act relative to defining affordable housing under chapter 40B..

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Section 20 of Chapter 40B of the General Laws, as appearing in the 2004 Official Edition, is herby amended under the definition of “Consistent with local needs” by adding at the end thereof the following: A municipality shall be exempt from the provisions of this chapter if the percentage of total units of affordable market rate rental housing units, as determined by the most recent state or federal data, is equal to or greater than forty percent of the total housing units in the municipality.
