An Act relative to vendor contracts.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 12 of chapter 11 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by inserting after the word “commonwealth.”, in line 69, the following sentence:- Said access shall include access as defined above, to any grant, contract or agreement between said vendors and any other entity, provided the grant or contract is to provide services related to, and funded by, the vendor’s contract with the commonwealth, or to provide goods directly and specifically related to, and funded by, the vendor’s contract with the commonwealth.
SECTION 2. Said section 12 of said chapter 11 of the General Laws, as so appearing, is hereby further amended by inserting after the word “section.”, in line 72, the following sentence:- In addition, any grant, contract or agreement between said vendors and any other entity providing services to said vendors, provided the grant or contract is to provide services related to, and funded by, the vendor’s contract with the commonwealth, or to provide goods to said vendor that are directly and specifically related to a vendor’s contract with the commonwealth, the funding for said goods being the vendor’s contract with the commonwealth, shall include a clause providing the state auditor with access to said other entity’s accounts, books, records and activities, except tax returns, related to provision of such services or goods to the vendor.
