An Act Authorizing the Town of Cohasset to Transfer Certain Interests in Land.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. The town of Cohasset, acting by and through its board of water commissioners and the board of selectmen, may transfer to its board of selectmen the care, custody and control of a certain portion of a certain parcel of land acquired for water supply purposes to be used for general municipal purposes. The parcel is described in an order of taking made by the town on October 25, 1950 and recorded at the Norfolk county registry of deeds in book 2950, page 182 and is located northwesterly of Sohier street and is shown on assessors map 15 as parcel 1. The portion of the parcel to be transferred by the town contains 6,244 square feet and is shown as “parcel 1A” on a plan entitled “Plan of Land, North Main Street & Sohier Street in Cohasset, MA,” dated October 25, 2011 and prepared by Cavanaro Consulting.
SECTION 2. Notwithstanding any general or special law to the contrary, the board of selectmen may transfer such parcel 1A to the Social Service League of Cohasset, Inc. or its designee, for the purpose of utilizing such parcel in the construction of a Senior Center for the town.
SECTION 3. Notwithstanding any general or special law to the contrary, the board of selectmen of the town of Cohasset may transfer to the Cohasset Swimming and Recreation Trust, under declaration of trust dated November 23, 1970 and recorded in the Norfolk county registry of deeds in book 4885 at page 256, a portion of a parcel of land acquired by the town of Cohasset by deed dated July 2, 1914 located southerly of North Main street and described in certificate of title number 2241 and plan 4899-A on file with the Norfolk county registry district of the land court. The portion to be transferred to such trust contains 10,877 square feet and is shown on the plan referenced in section 1 as “parcel 13A”. The parcel described in said certificate of title is shown as “Lot 2” on said plan prepared by Cavanaro Consulting as set forth in said section 1.
SECTION 4. The board of selectmen may transfer to the Social Service League of Cohasset, Inc., or its designee, and said Cohasset Swimming and Recreation Trust easements over a portion of “Lot 2” on such plan prepared by Cavanaro Consulting for access and utility purposes. The easement area contains 13,790 square feet and is shown on said plan referenced in sections 1 and 3 as “40’ Wide Access and Utility Easement”.
SECTION 5. If the land conveyed to said Social Service League of Cohasset, Inc as set forth in section 2 ceases to be used for public purposes, the parcel described in section 1 as “Parcel 1A” shall revert to the board of selectmen of the town of Cohasset for general municipal purposes and such easements granted to said corporation as set forth in section 4 shall terminate.
SECTION 6. This act shall take effect upon its passage.
