AN ACT AUTHORIZING THE TOWN OF HINGHAM TO TRANSFER AND CHANGE THE USE OF CERTAIN PARCELS OF LAND IN THE TOWN.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  The town of Hingham, acting by and through its board of selectmen, may transfer a certain parcel of land located off Fort Hill street containing approximately 3.21 acres, being a portion of a parcel acquired by the town of Hingham from the U.S. Department of the Interior by deed dated May 12, 1972 for park and recreation purposes, to the town for general municipal use.   The location of the 3.21 acres of land is adjacent to the town of Hingham school bus storage site and the municipal fueling station and, as such, is more suitable for municipal purpose use to the town.  A corrective deed to the town dated June 27, 1973 was recorded in book 3917, page 327 in the Plymouth county registry of deeds.  The land to be transferred is a portion of Lot 1 on assessors map 77 and is also shown as “Parcel 2” on a plan entitled “Open Space Modification Plan, Bare Cove Park Drive, Hingham, MA 02043” prepared for the town of Hingham by Coler & Colantonio, Inc. and dated March 8, 2012.

SECTION 2.  In consideration for the transfer authorized in section 1, the town of Hingham shall dedicate a parcel of land containing approximately 10.08 acres, being a portion of a parcel acquired by the town from the U.S. Department of Health, Education and Welfare by deed dated December 17, 1973, described as “School Tract IV” in such deed, currently held for general municipal use, to park and recreation purposes.  The restrictions limiting the use of such parcel for education purposes expired after 30 years in accordance with such deed. The parcel is a portion of Lot 44 on assessors map 69 and is also shown as “Parcel 1” on the Coler & Colantonio, Inc. plan referenced in said section 1.  The board of selectmen may grant restrictions on such parcel, as they deem necessary and appropriate.

SECTION 3. The parcels of land described in sections 1 and 2 are subject to certain restrictions and covenants as set forth in the deeds from the U.S. Department of the Interior and the U.S. Department of Health, Education and Welfare to the town of Hingham.  The transfer and change of use of such parcels as set forth in said sections 1 and 2 of this act by the town of Hingham shall be subject to advance written approval by the U. S. Department of the Interior or its designee.

SECTION 4. The town of Hingham shall execute, acknowledge and deliver to the U. S. Department of the Interior, or its successor, or designee such further deeds or instruments or other documents as may be necessary to effectuate the purposes of this act.

SECTION 5. This act shall take effect upon its passage.
