SECTION 1. The conservation commission of the town of Maynard may transfer the care, custody, management and control of a certain 2.07 acre portion of a parcel of land identified on assessors’ map 5 as parcel 4, which was acquired by the town and held for conservation purposes, to the board of selectmen. The parcel, which has been declared surplus, is approximately 450 feet in length and 200 feet deep and abuts the rear parking lot at 124 Acton street. The board of selectmen, acting on behalf of the town of Maynard, may convey the 2.07 acre portion of the parcel to the adjacent property owner to allow for the expansion of such owner’s building at 124 Acton street and such conveyance shall be subject to subsections (a), (b) and (g) of section 16 of chapter 30B. The 2.07 acres are also shown on a plan entitled “Two Acre Conservation Parcel Adjacent to 124 Acton Street” on file in the office of the town clerk.
SECTION 2. In consideration for the conveyance of the 2.07 acre parcel authorized in section 1, the grantee shall make a payment to the town of Maynard in an amount to be determined by the town in accordance with the fair market value of the property based upon an appraisal report prepared for the town of Maynard and the grantee.
SECTION 3. To ensure a no net loss of lands protected for conservation purposes under section 1, the town of Maynard shall purchase a certain 12-acre parcel of land located at 18 Winter street in said town which has significant conservation value and is located adjacent to the town-owned bike and walking trail off 18 Winter street. Such transaction shall be subject to subsections (a), (b) and (g) of section 16 of chapter 30B. The parcel is identified on assessors’ map 23 as lot 3 and contains second growth forest and a number of vernal pools and other significant natural features. If the owner of the parcel at 18 Winter street fails to deliver that property to the town as a portion of the consideration for the conveyance authorized in section 1, the town of Maynard shall not convey the parcel described in section 1 to the owners of 124 Acton street.
SECTION 4. The board of selectmen may enter into any agreements and execute any instruments necessary on behalf of the town to effectuate the conveyance and acquisition under sections 1 and 3.
SECTION 5. This act shall take effect upon its passage.
