An Act to include substituted cathinones, also known as "bath salts," in class C substances.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Subsection (e) of Class C of Section 31 of Chapter 94C of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by adding the following 2 subsections:

(f)  Any compound, other than buproprion, that is structurally derived from 2-amino-1-phenyl-1-propanone by modification in any of the following ways:

(i) Substitution in the phenyl ring to any extent with alkyl, alkoxy, alkylenedioxy, haloalkyl, or halide substituents, whether or not further substituted in the phenyl ring by one or more other univalent substituents;

(ii) Substitution at the 3-position with an alkyl substituent;

(iii) Substitution at the nitrogen atom with alkyl or dialkyl groups, or by inclusion of the nitrogen atom in a cyclic structure.

(g)  Unless specifically excepted or listed in another schedule, any material, compound, mixture, or preparation, which contains any quantity of the following hallucinogenic substances, or which contains any of their salts, isomers, and salt of isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation:

(1)  4-methylmethcathinone (Mephedrone; Mephadrone; 4-MMC)

(2)  2-(methylamino)-propiophenone; alpha-(methylamino)propiophenone (Methcathinone)

(3)  3,4-methylenedioxypyrovalerone (MDVP)

(4)  3,4-methylenedioxymethcathinone (Methylone; MDMC)

(5)  4-methoxymethcathinone (Methedrone; bk-PMMA; PMMC)

(6)  4-fluoromethcathinone (Flephedrone)

(7)  3-fluoromethcathinone (3-FMC)

(8)  3-methoxymethcathinone (HMMC)

(9)  4-methyl-alpha-pyrrolidinobutyrophenone; (RS)-1-(4-methylphenyl)-2-(1-pyrrolidinyl)-1-butanone) (MPBP)

(10)  2-(methylamino)-1-phenylpropan-1-one (Ephedrone)

(11)  4-ethylmethcathinone (4-EMC)

(12)  3,4-Dimethylmethcathinone (3,4-DMMC)

(13)  Alpha-Pyrrolidinopentiophenone (Alpha-PVP)

(14)  Naphthylpyrovalerone (Naphyrone; NRG-1)

(15)  Beta-Keto-N-methylbenzodioxolylpropylamine (Butylone)

(16)  Beta-Keto-N-methylbenzodioxolylpentanamine (Pentylone)

(17)  Beta-Keto-Ethylbenzodioxolylbutanamine (Eutylone)

(18)  3,4-methylenedioxy-N-ethylcathinone; (RS)-1-(1,3-benzodioxol-5-yl)-2-(ehtylamino)propan-1-one (Ethylone; MDEC; beta-Keto-MDEA)

(19)  5,6-Methylenedioxy-2-aminoindane (MDAI)

(20)  (1-(4-methylphenyl)-2-(1-pyrrolindinyl-1-pentanone)) (Pyrovalerone)

(21)  N-ethylcathinone; 2-ehtylaminopropiophenone; beta-Keto-ethylamphetamine; 2-ehtylamino-1-phenyl-propan-1-one (Ethcathinone; Ethylpropion)

(22)  N,N-dimethylcathinone; 2-(dimethylamino)-1-phenyl-1-propanone (Metamfepramone)

(23)  Alpha-pyrrolidinopropophenone; 1-phenyl-2-(10pyrrolidinyl)-1-propanone (Alpha-PPP)

(24)  4’-methoxy-alpha-pyrrolidinopropiophenone; 1-(4-methoxyphenyl)-2-(pyrrolidin-1-yl)propan-1-one (MOPPP)
