An Act to provide personal care attendant orientation program.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 32(b) of Chapter 118G of the General Laws, as appearing in the 2006 official edition, is hereby amended by inserting at the end the following:  “The council and 1199SEIU shall work jointly with other interested stakeholders to establish a new personal care attendant orientation program for all persons newly hired as a personal care attendant.  Said orientation shall supplement and not replace training provided by consumers.  Said orientation may include training on independent living principles, identifying and reporting of fraud and abuse, and workers’ rights and responsibilities.   Said orientation shall be completed within four months of initial employment as a personal care attendant and shall take no longer than four hours to complete.   Persons currently employed as a personal care attendant shall be exempt from the legal requirement to complete said orientation.  Nothing in this section shall change or alter the PCA program principles of consumer direction and consumer control.”
