An Act relative to birth records.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Chapter 262 of the General Laws is hereby amended by inserting after section 34 the following section:-

Section 34B.  the following persons may obtain a copy of birth records under section 34.  The registrant, (a person listed on the certificate) or a parent or legal guardian.

A party entitled to receive the record as the result of a court order.

A member of a law enforcement agency or a representative of another governmental agency as provided by law.

A child, grandchild, brother, sister, spouse or domestic partner of the registrant.

An attorney representing the registrant or his estate or a person or agency empowered by law or appointed by a court to act on behalf of the registrant or his estate.

An agent or employee of a funeral establishment who acts within the course of his employment to obtain copies of birth records on behalf of the above persons.

A person obtaining a copy of birth record shall be required to present a valid photo I.D.  except the registrant.  The city or town clerk shall maintain of record of the same.
