Costello that vehicles owned and operated by a public utility or public service corporation or under contract to a public utility or public service corporation and performing emergency service be included under the "move over" law, so-called. Joint Committee on Transportation.

In the Year Two Thousand Eleven

An Act to expand the move over law for utility vehicles.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1:  Section 7 of Chapter 89 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by inserting after the word “person,” in line 4, the following:-

vehicles owned and operated by a public utility or public service corporation or any under contract to a public utility or public service corporation and performing emergency service,

SECTION 2:  Section 7A of Chapter 89, as so appearing, is hereby amended by inserting after the word “ambulance,” in line 2, the following:-  public utility or public service corporation.

SECTION 3:  Section 7C of Chapter 89, as so appearing, is hereby amended by inserting after the definition of “Person” the following definition:-

“Public Utility vehicle”, any vehicle owned and operated by a public utility or public service corporation or any under contract to a public utility or public service corporation and performing emergency service.

SECTION 4:  Section 7C of Chapter 89, as so appearing, is here by amended by inserting after the phrase “highway maintenance vehicle”, in line 24, the following:-  public utility vehicle.
