An Act relative to temporarily suspending the state gas tax in order to provide relief to Massachusetts.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 4 of chapter 64A of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by adding, in lines 5 and 10, after the word ‘return’, in each instance, the following:-
"; provided, that if the average price of fuel, as determined pursuant to section 3A of chapter 64A, is equal to or exceeds $2.50 per gallon, the commissioner shall suspend the enforcement of this provision until such time as the average price of fuel, as determined pursuant to said section of this chapter, is less than $2.50 per gallon".
SECTION 2. Section 1 of this act is hereby repealed.
SECTION 3. Section 2 shall take effect on December 31, 2013.
