An Act relative to the safety of police, fire and medical personnel.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

                SECTION 1. Notwithstanding the provisions of any general or special law to the contrary, any law enforcement officer, fire department officer or health care provider who in the performance of their work responsibilities is exposed to bodily substance, as defined in Section 38 of Chapter 127, the exposed person may petition the superior court for an order compelling: (1) the production of medical, insurance, or other records to determine the presence of any infectious disease, as defined by the department of public health, in the blood or other bodily fluid of the transmitting person; and (2) the testing of the blood from the individual for infectious disease.

                 SECTION 2. The results of the blood tests shall be confidentially transmitted to the law enforcement officer, fire department officer or health care provider only if there is a determination of a positive result.
