An Act authorizing the city of Westfield to convert a seasonal license for the sale of all alcoholic beverages not to be drunk on the premises to an annual license for the sale of all alcoholic beverages not to be drunk on the premises.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  (a) Notwithstanding sections 17 and 17B of chapter 138 of the General Laws, the licensing authority of the city of Westfield may convert 1 currently-issued seasonal license for the sale of all alcoholic beverages not to be drunk on the premises located at 1230 Russell road to an annual license for the sale of all alcoholic beverages not to be drunk on the premises located at 1230 Russell road.  An annual license granted under this act shall be subject to all of said chapter 138, except said sections 17 and 17B.

(b) The licensing authority in the city of Westfield shall not approve the transfer of the license to any other person, organization, corporation or location but it may grant the license to a new applicant at the same location if the applicant files with the licensing authority a letter from the department of revenue indicating that the license is in good standing with the department and that all applicable taxes have been paid.

(c) If the license granted under this section is cancelled, revoked or longer in use, it shall be returned physically with all of the legal rights, privileges and restrictions pertaining thereto, to the Westfield licensing board which may then grant the license to a new applicant at the same location under the same terms and conditions as specified in this act.

(d) An annual license issued or reissued pursuant to this act shall be subject to an original application fee of $4,000 which shall be in addition to the annual fee charged for all alcoholic beverages licenses not to be drunk on the premises in the city of Westfield.  The original fee shall be paid at the time of issuance or reissuance of the license, as the case may be, and deposited into an economic development account in the city of Westfield and expended consistently with the purposes of that account.

SECTION 2.  This act shall take effect upon its passage
