An Act regarding special education.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Section 5A (c) of chapter 71B of the General Laws is hereby amended by adding to the end of paragraph 1 the following:-  ", or the percent increase in the standard rate of eligible services as determined annually by the department of Elementary and Secondary Education".

SECTION 2.  Section 2 of Chapter 70 of the General Law is hereby amended by striking the third and fourth paragraphs and inserting in place thereof the following paragraphs:- "Assumed tuitioned-out special education enrollment, the percentage of students included in foundation enrollments who participate in an Individual Education Plan and attend an out-of-district placement.  The percentage shall be based on the preceding academic year. 

"Assumed in-school special education enrollment", the percentage of students included in foundation enrollments who participate in an Individual Education Plan and attend an in-district placement.  The percentage shall be based on the preceding academic year.
