An Act further regulating certain licenses for the sale of alcoholic beverages.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 15 of Chapter 138 of the General Laws, as appearing in the Official 2008 Edition, is hereby amended by striking out in line 22 the word “three” and inserting in place there of the following words “five.”

SECTION 2. Section 15 of Chapter 138 of the General Laws, as appearing in the Official 2008 Edition, as amended, is hereby amended by striking out in line 22 the word “five” and inserting in place there of the following words “seven.”

SECTION 3. Section 15 of Chapter 138 of the General Laws, as appearing in the Official 2008 Edition, as amended, is hereby amended by striking out in line 22 the word “seven” and inserting in place there of the following words “nine.”

SECTION 4.  Section 15 of Chapter 138 of the General Laws, as appearing in the Official 2008 Edition, is further amended by adding after the word “results” in line 26, the following words, “or contract for the provision of personal services in the business operation”

SECTION 5. Section 15 of Chapter 138 of the General Laws, as appearing in the Official 2008 Edition, is hereby amended by striking out in line 27 the number “3” and inserting in place there of the following number “5.”

SECTION 6. Section 15 of Chapter 138 of the General Laws, as appearing in the Official 2008 Edition, as amended, is hereby amended by striking out in line 27 the number “5” and inserting in place there of the following number “7.”

SECTION 7. Section 15 of Chapter 138 of the General Laws, as appearing in the Official 2008 Edition, as amended,  is hereby amended by striking out in line 27 the number “7” and inserting in place there of the following number “9.”

SECTION 8. Section 15 of Chapter 138 of the General Laws, as appearing in the Official 2008 Edition, is further amended by adding after the sentence ending in “city” in line 28, the following new sentence, “All applicants for new licenses or transfer of license when the issuing of such new license or transfer shall result in the applicant owning more than three licenses shall pay a fee of up to $5,000 to the commission upon approval of the application prior to the granting of said license for each such new license or transferred license."

SECTION 9. Chapter 138 of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by adding the following new section:-

Section 15B.  There is hereby created on the books of the commonwealth an account for the purpose of collecting the fees specified in Section 15 of Chapter 138.  Expenditures from said account shall be subject to appropriation.

SECTION 10. SECTION 4 of this act shall apply to all any license under Section 15 granted after January 1, 2012.

SECTION 11. SECTIONS 1 and 5 of this bill is to become effective on January 1, 2012.

SECTION 12. SECTIONS 2 and 6 of this bill is to become effective on January 1, 2016.

SECTION 13. SECTIONS 3 and 7 of this bill is to become effective on January 1, 2020.
