An Act establishing a consumer compensation fund.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Notwithstanding the provisions of any Massachusetts General Law or special law to the contrary, the City Council of the City of Quincy hereby petitions the Great and General Court of the Commonwealth:

1)  To establish a Consumer Compensation Fund for the benefit of Massachusetts Electric Company d/b/a National Grid’s customers served by said utility as ratepayers residing in or conducting business in the City of Quincy.  Said Consumer’s Compensation Fund shall be established for the purpose of reimbursement of those ratepayers for whom expenses and monetary losses were incurred as a result of the impacts of Hurricane Irene which are directly related to the extended loss of electrical service provided by Massachusetts Electric d/b/a National Grid.  Monies to establish this fund shall be those that are obtained through any penalty assessed against Massachusetts Electric d/b/a National Grid by the Department of Public Utilities pursuant to G. L. Chapter 164 1J, provided that any penalty assessed or settlement agreement reached in any regulatory or enforcement action undertaken, the proceeds of which are employed to establish the Consumer Compensation Fund and carry out the intent of this act, shall not be borne by the ratepayers.

2)  To direct the Department of Public Utilities to promulgate procedures for the management of, application for and disbursement of proceeds from said fund.
