An Act authorizing the town of Milton to grant an additional license for the sale of all alcoholic beverages to be drunk on the premises of a certain restaurant.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding sections 11 and 17 of chapter 138 of the General Laws, the licensing authority of the town of Milton may grant an additional license for the sale of all alcoholic beverages to be drunk on the premises to the restaurant located at 95 Eliot street, which is owned by Daniel P. Kerrigan or his successor in interest; provided, however, that any successor in interest shall be subject to approval by the board of selectmen and the alcoholic beverages control commission; provided further, that an application to transfer the license to a successor in interest shall be granted and approved according to the standard for a new license. All of the procedures set forth in section 15A of said chapter 138 shall apply to the granting of a license to a successor in interest. The license shall be subject to all of said chapter 138, except said section 17. The licensing authority shall not approve the transfer of the license to any other location but it may grant it to a new applicant at the same location if the applicant for the license files with the licensing authority a letter from the department of revenue indicating that the license is in good standing with the department and that all applicable taxes have been paid.

If the license granted under this act is cancelled, revoked or no longer in use, it shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority which may then grant the license to a new applicant at the same location under the same conditions as specified in this act.

SECTION 2. This act shall take effect upon its passage.
