An Act Message from His Excellency the Governor, (pursuant to Part the Second, Chapter 1, Section 1, Article II of the Constitution of the Commonwealth of Massachusetts) returning unsigned Senate Bill No. 2137, “An Act Authorizing the Exchange of Certain Parcels of Land in the Town of Marshfield.”.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

To the Honorable Senate and House of Representatives:

Pursuant to Part the Second, Chapter 1, Section 1, Article II of the Constitution of the Commonwealth of Massachusetts, I am returning unsigned Senate Bill No. 2137, “An Act Authorizing the Exchange of Certain Parcels of Land in the Town of Marshfield.” 

This Article 97 legislation authorizes the transfer of approximately 2 acres of Marshfield conservation land from the Conservation Commission to the Board of Selectmen to be held for use as the site of a wind turbine electricity generation facility.  In exchange, the Town must acquire a 5.05 parcel of land, which is surrounded by conservation land and wetlands, for conservation, groundwater protection and water supply purposes. 

While I support the substance of this bill, the 2/3 roll call votes required for passage by Article 97 of the Amendments to the Constitution were not taken.  For this reason, I return Senate Bill No. 2137 unsigned.
