An Act regulating the transportation of oil fuel..
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Chapter 21K of the General Laws is hereby amended by adding at the end the following additional section:
"Section 21L. Registration for commercial transport of fuel.
Section 21L. (A) No person shall remove or transport fuel (including, but not limited to, oil, natural gas, and propane gas) commercially through the streets of any city or town without registering with the Department of Environmental Protection. Such registration shall be in such form and contain such information, on oath, as the department shall require, but in all cases shall include (1) the name, address, and telephone number of the corporation transporting the fuel and the owner of the corporation; (2) the name, address, and telephone number of the owner of the means of transport, if different; (3) the name, address, and telephone number of the corporation whose emblem appears on the means of transport, if applicable; and (4) the name of each city or town in which the corporation stores or delivers fuel. No fee shall be assessed for the registration process. Such registration shall be valid for three years, and may be renewed without limitation. Upon receiving such registration, the department shall, within 30 days, notify each city or town named in the registration and make available to them all information contained in the registration.
(B) Any person or corporation commercially transporting fuel without first registering with the department shall be subject to a fine not to exceed $10,000 for each violation, payable to each city or town in which the fuel is unlawfully stored or delivered."
