An Act clarifying eligibility for small group health insurance.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 1 of said chapter 176J, as amended by section 20 of chapter 288 of the acts of 2010, is hereby amended by striking out the definition of “Eligible individual” and inserting in place thereof the following definition:-
“Eligible individual”, an individual who is a resident of the commonwealth and who is not seeking individual coverage to replace an employer-sponsored health plan for which the individual is eligible and which provides coverage that is at least actuarially equivalent to minimum creditable coverage, or who has access to, or has waived access to, an employer-sponsored health plan.
