An Act relative to indemnity in installation of energy efficiency improvements in condominiums.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

                SECTION 1. Subsection (b) of section 5 of chapter 183A of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by inserting, in line 60, after the words, “subsection (5) of section 4” the following words:-

"provided however, that such grant or designation shall not be contingent upon said unit owner signing an agreement that indemnifies the governing board if such grant or designation is to make an energy efficiency improvement.  For the purposes of this section, an energy efficiency improvement shall include, but shall not be limited to, installation of insulation, exterior doors, windows, fire rated doors that lead to the common area hallways, interior and exterior luminaries as defined in 527 CMR 12.00; provided further, that the board of building regulations and standards may promulgate regulations to add new energy efficiency improvements for the purposes of this section."
