An Act relative to the estate of homestead.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 3(b)(2).  Chapter 188 is amended by amending the following language in Section 3(b)(2) as follows:

Section 3(b)(2) for a lien on the home recorded prior to the creation of the estate of homestead for fraud or defalcation while acting in a fiduciary capacity, embezzlement or larceny for willful and malicious injury to another entity or to the property of another entity; Notwithstanding  any other section or subsection of this Chapter 188, this Section 3 (b)(2) shall be subordinate to, and shall include any and all exemptions provided in 11 U.S.C. § 522(c) and 11 U.S.C. § 522(f).
