An Act regarding criminal motor vehicle citations..
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 2 of chapter 90C of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by striking out lines 104 through 115 and inserting in place thereof the following:-
(b) in the case of citations alleging one or more criminal automobile law violations, shall cause one copy of such citations to be mailed or delivered to the registrar and one copy of such citations to be delivered to the clerk-magistrate of the district court for the judicial district where the violation occurred. Failure to comply with the provisions of this paragraph shall not constitute a defense to any complaint or indictment charging a violation of section twenty-four, twenty-four G or twenty-four L of chapter ninety if such violation resulted in one or more deaths. Each clerk-magistrate shall maintain a record in the form prescribed by the chief justice of the district court department of such citations and shall notify the registrar of the disposition of such citations in accordance with the provisions of section twenty-seven of said chapter ninety.
SECTION 2. The second paragraph of section 4 of chapter 90C of the General Laws, as so appearing, is hereby amended by striking out the second sentence and inserting in place thereof the following sentence:- If any such arrest is made, it shall be noted on the citation and one copy of the citation shall be mailed or delivered to the registrar and one copy of the citation shall be delivered to the clerk-magistrate of the district court for the judicial district where the violation occurred.
