An Act regarding arraignments on subsequent criminal offenses.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

                SECTION 1. Chapter 278 of the General Laws, as appearing in the 2006 Official Edition,  is hereby amended by striking out the first sentence of section 11A and inserting in place thereof the following sentence:- If a defendant is charged with a crime for which more severe punishment is provided for second and subsequent offenses, and the complaint or indictment alleges that the offense charged is a second or subsequent offense, the defendant on arraignment shall be inquired of for pleas of guilty or not guilty to the crime charged and the subsequent offense.
