Brownsberger, Sonia Chang-Diaz and other members of the General Court for legislation authorizing the Division of Capital Asset Management to lease a certain property in the town  of Weston.  State Administration and Regulatory Oversight.

An Act authorizing the Division of Capital Asset Management to lease a certain property in the town  of Weston.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding the provisions of sections 40E to 40J inclusive, of Chapter 7 of the general laws or any other general or special law to the contrary, the commissioner of the division of capital asset management may, in consultation with the commissioner of the department of conservation and recreation, enter into a lease for a term not to exceed 30 years with the Charles River Watershed Association, Inc., a 501(c)(3) non-profit corporation whose mission is to protect and enhance the health, beauty, and accessibility of the Charles River and its watershed, to occupy the Ouimet Museum and Golf House at the Leo J. Martin Golf Course, 190 Park Road, Weston, Massachusetts, under the custody and control of the department, for office and meeting space.

SECTION 2. The consideration for the lease shall be determined by the division of capital asset management, in consultation with the department of conservation and recreation, consistent with the rent determinations made for other non-profit entities that lease from the commonwealth and taking into account: the public benefits of educational outreach, programming, water-quality monitoring services, river protection, and the capital improvements and maintenance on the property performed by Charles River Watershed Association, Inc., and need for future improvements to the property.

SECTION 3. The Charles River Watershed Association, Inc. shall assume the costs of any appraisals, surveys and other expenses required by the division of capital asset management for the granting of the lease. 

SECTION 4. If Charles River Watershed Association, Inc. ceases at any time during the term of the lease to use the property for office and meeting space, the lease shall be terminated immediately under such terms and conditions as the division of capital asset management and maintenance, in consultation with the department of conservation and recreation, may prescribe.

SECTION 5. All revenues received by the Department under this act shall be deposited in the Conservation Trust Fund established pursuant to chapter 132A, section one of the general laws.
