An Act relative to affordable housing units.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 40B of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by inserting after the section 20 the following section:-

Section 20A. The following words, wherever used in this chapter, shall, unless a different meaning clearly appears from the context, have the following meaning:

“Affordable Housing Unit”, any unit assessed at a value affordable to a household earning less than 80% of the area median income. If such unit meets this criterion for a five consecutive years, it shall count toward the town's ten percent of housing unit threshold established pursuant to the definition of “consistent with local needs,” under section 20 of this chapter.

The Department of Housing and Community Development, as established in section 1 of chapter 23B, shall promulgate regulations for the implementation of this section.
