An Act relative to affordable housing near areas of critical concern.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

1.  Section 21 of said Chapter 40 B of the General Laws is hereby amended by adding after the word "consultants" the following "however, notwithstanding any general or special law, rule, or regulation to the contrary including the provisions hereof, shall this board of appeals issue said comprehensive permit for any area, site or land which the Commonwealth by any of its agencies or subdivisions thereof have designated as an area of conservation concern, or core habitat or critical natural concern". 

2. 23 of Chapter 40 B is hereby further amended by adding after the words "local needs" the following "and  is not located upon an area designated by the Commonwealth, any of its agencies or subdivisions thereof to be and/or contain core habitat, or conservation concern or critical natural landscape"
