Resolved, Whereas, affordable housing is an appropriate and important public policy initiative;
Therefore be it resolved,
SECTION 1. There shall be a special commission entitled the “Affordable Housing Development Regulation Review Commission” to study and make recommendations concerning the implementation of chapter 40B of the General Laws.
SECTION 2. The special commission shall consist of 13 members:
4 members of the general court, 1 of whom shall be appointed by the speaker of the house, 1 of whom shall be appointed by the house minority leader, 1 of whom shall be appointed by the senate president, and 1 of whom shall be appointed by the senate minority leader;
the director of the department of housing and community development, or the director’s designee;
3 representatives of the Home Builders Association of Massachusetts;
a representative of Mass Housing;
a representative of the Citizens’ Housing and Planning Association;
a representative of the Community Preservation Association;
a representative of the Massachusetts Bar Association with experience in zoning law;
and a representative of the Massachusetts Municipal Association.
The speaker of the house and the senate president shall determine which 2 members of the special commission shall serve as co-chairmen.
SECTION 3. The commission shall study and make recommendations on 760 CMR 56 and other regulations and policies established by the department of housing and community development, including but not limited to fee structures, timeframes for approval of permits and certifications, auditing requirements, and the developer’s guide.
SECTION 4. Members of the commission shall be named and the commission shall commence its work within 60 days of the effective date of this resolve. The commission shall report to the general court the results of its study, and together with draft legislation necessary to implement its recommendations by filing the same with the clerks of the senate and the house of representatives and the house and senate chairs of the joint committee on housing, 365 days after the effective date of this resolve.
