An Act empowering the Sex Offender Board to reclassify repeat sex offenders.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Chapter 6 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after section 178D the following section:-
Section 178D1/2. A sex offender who is charged with, or convicted of, committing a subsequent offense which requires registration under sections 178C to 178P, inclusive, may be re-classified by the board to a higher level designation of sex-offender. Upon making such reclassification, the board shall update the sex offender registry.
SECTION 2. The sex offender registry board shall promulgate regulations implementing this act within 120 days of its effective date.
