An Act relative to misuse of debit cards.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Section 105 of Chapter 93 of the General Laws as appearing in the 2010 official edition is hereby amended by inserting, after the word “transactions” in line 8, the following words:-

including debit card transactions;

SECTION 2.  Section 41 of Chapter 183B of the General Laws as appearing in the 2010 official edition is hereby amended by striking out, in lines 26 and 27, the words “credit card” and inserting in place thereof, in each instance, the following figure:-

credit card or debit card

SECTION 3.  Section 37A of Chapter 266 of the General Laws as appearing in the 2010 official edition is hereby amended by striking out the definition of “credit card” and inserting in place thereof the following definition:-

“Credit card”, any instrument or device, whether known as a credit card, credit plate, or by any other name, issued with or without fee by an issuer for the use of the cardholder in obtaining money, goods, services, or anything else of value on credit; or a debit card.

SECTION 4.  Said Section 37A of Chapter 266 is hereby further amended by inserting after the definition of “Credit card” the following definition:-

“Debit card”, any instrument or device, whether known as a debit card or by any other name, that is issued with or without a fee by an issuer for the use of the cardholder in obtaining money, property, goods, services or anything else of value, subject to the issuer removing money from the checking account, savings account, or any other account of the cardholder.
