An Act relative to the awarding of costs and attorney’s fees.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1.Section 59H of Chapter 231 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after the first sentence of the fifth paragraph the following sentence:-
The court may also award costs and reasonable attorney’s fees to the moving party if the plaintiff voluntarily dismisses the action after said special motion to dismiss is filed but prior to the court’s ruling on said motion.
