By Representatives Coakley-Rivera of Springfield and Provost of Somerville, a petition (accompanied by bill, House, No. 1708) of Cheryl A. Coakley-Rivera and others for legislation to further regulate the method of calculating the period of time for employees in filing certain complaints with the Attorney General under the labor relations laws of the Commonwealth.  Labor and Workforce Development.

In the Year Two Thousand Thirteen

An Act establishing uniform wage compliance and recordkeeping.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Section 150 of chapter 149 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting after the word “benefits,” in line 27, the following words:-

; provided, however, that the 3-year limitation period shall be tolled from the date that the employee or a similarly situated employee files a complaint with the attorney general alleging a violation of any of these sections until the date that the attorney general issues a letter authorizing a private right of action or the date that an enforcement action by the attorney general becomes final.

SECTION 2.  Section 15 of chapter 151 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by striking out, in line 6, the word “two” and by inserting after the word “least,” in line 6, the following word:-

SECTION 3.  Section 20A of chapter 151 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by striking out, in line 2, the word “two,” and by inserting after the word “than,” in line 2, the following word:-

SECTION 4.  Said section 20A of said chapter 151, as so appearing, is hereby further amended by inserting after the word “action,” in line 3, the following words:-

; provided, however, that the limitation period shall be tolled from the date that the employee or a similarly situated employee files a complaint with the attorney general alleging a violation of this chapter until the date that the attorney general issues a letter authorizing a private right of action or the date that an enforcement action by the attorney general becomes final.
