SECTION 1.
Any municipality in the Commonwealth classified as a city, including the sixteen municipalities that have applied for and been granted city forms of government, but wish to be called “town,” may establish in their office of the parking clerk or equivalent office a list of home health care clinicians with vehicle registrations and the home care agency they are employed with for the purposes of caring for homebound or other individuals needing home care services.
Individuals on this list shall be able to automatically overturn a parking ticket administered while the clinician was providing essential care services, as long as they are parked in a manner that does not impede vehicles related to public safety, handicap parking, or other commercial vehicles.
SECTION 2.
Home care agencies must be certified as a participating Medicare home health agency pursuant to Section 1891 of the Social Security Act, 42 U.S.C.A. § 1395bbb or be accredited as a private pay home care agency by the Home Care Alliance of Massachusetts.
SECTION 3.
Home care agencies that wish to obtain this right for their clinicians must pay an annual registration fee of $250 to the city in which they are providing care and which is maintaining an up to date list of clinicians servicing the city.
(b) Each participating home care agency is responsible for updating their list of clinicians at least every four months.
