An Act authorizing municipalities to utilize funds from enterprise accounts.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 53F ½ of chapter 44 of the General Laws is hereby amended by adding the following paragraph:-
Notwithstanding section 33B or any provisions herein to the contrary, the mayor, board of selectmen or other executive authority of the city or town may, without further appropriation, transfer from such enterprise fund established under this section, a surplus produced from such fund in any of the 5 preceding fiscal years, to the General Fund of such municipality; provided, however, that such transfer shall not be greater than any appropriation transferred from the General Fund to any such enterprise fund to balance a deficit in such enterprise fund in any of the 5 preceding fiscal years. For the purposes of this paragraph, acceptance in a city shall be by vote of the city council and approval of the mayor, in a town, by vote of a special or annual town meeting and in any other municipality by vote of the legislative body.
