An Act relative to suspending prescription drug coverage from minimum creditable coverage requirements.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 1 of chapter 111M of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by inserting, in line 46, at the end of the definition of the term “Creditable coverage”  the following:-

Minimum creditable coverage, as defined by the board under the authority granted herein, shall not require, in the case of individuals subject to this chapter, coverage for prescription drugs, except as provided in the essential health benefit benchmarks, established under the federal Patient Protection and Affordable Care Act.
