An Act relative to lead abatement.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1.Section 191 of chapter 111 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by striking out the last sentence in the first paragraph and inserting in place thereof the following:-
The term “lead poisoning” shall be defined as a disease present in a child when the child has a concentration of lead in whole venous blood of 10 micrograms per deciliter. The director shall by regulation with the advice of the advisory committee and in accordance with sound medical practice define the term “previously reported”.
SECTION 2. Subsection (a) of section 197C of chapter 111 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended further by striking out, in the first sentence, the words “in excess of the level considered dangerous to the child’s immediate health as determined by the department” and inserting in place thereof the following words:-
commensurate with lead poisoning as defined by this chapter
SECTION 3. Subsection (b) of section 197C of chapter 111 of the General Laws, as so appearing, is hereby amended further by striking out, in the first sentence, the words “in excess of the level considered dangerous to the child’s immediate health as determined by the department” and inserting in place thereof the following words:-
commensurate with lead poisoning as defined by this chapter
SECTION 4. Subsection (a) of section 199 of chapter 111 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended further by striking out, in the first sentence, the words “at which the department defines lead poisoning” and inserting in place thereof the following words:-
for lead poisoning, which is defined in section 191 of chapter 111.
SECTION 5. Subsection (e) of section 6 of chapter 62 of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by striking out, in the first sentence, the words “one thousand five hundred dollars” and inserting in place thereof the following words: - three thousand dollars
SECTION 6. Subsection (e) of section 6 of said chapter 62 of the General Laws, as so appearing, is hereby amended by striking out, in the second sentence, the words “five hundred dollars” and inserting in place thereof the following words: - one thousand dollars
SECTION 7. Section 5 of chapter 151B of the General Laws, as appearing in the 2010 Official Edition, is hereby amended by striking out, in clause (a) of the last paragraph, the dollar amount “$10,000” and inserting in place thereof the following dollar amount: - $20,000
SECTION 8. Section 5 of said chapter 151B of the General Laws, as so appearing, is hereby amended by striking out, in clause (b) of the last paragraph, the dollar amount “$25,000” and inserting in place thereof the following dollar amount: - $35,000
SECTION 9. Section 5 of said chapter 151B of the General Laws, as so appearing, is hereby amended by striking out, in clause (c) of the last paragraph, the dollar amount “$50,000” and inserting in place thereof the following dollar amount: - $60,000
