In the Year Two Thousand Thirteen

An Act relative to the use of fireworks.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Line one of Section 12 of Chapter 148 of the General Laws is herby amended by inserting after the word “fireworks”- “as defined by Section 90 of Chapter 148 of the General laws of Massachusetts” and by inserting after the word “person” in Line 7 “under the age of thirteen”
The first sentence of section 39 of Chapter 148 of the General Laws is hereby amended by inserting after the word “person” the following words- under the age of thirteen and Section 39 of chapter 148, as so appearing, is hereby further amended by striking out the second paragraph and inserting in place thereof the following paragraph:-
“For the purposes of this section the word “fireworks” shall refer to consumer fireworks that have been outlined as “safe and sane” as determined by the Massachusetts State Fire Marshall. The word “fireworks” as used in this section shall not refer to anything that has been outlined as “dangerous” and or exempt from public use or sale by the State Fire Marshall. “
The first sentence of section 40 of Chapter 148 of the General Laws is hereby amended by inserting after the word “person” the following words- under the age of thirteen” and by inserting after the word “fireworks” the following words- “as defined by Section 90 of Chapter 148 of the General laws of Massachusetts”.
