An Act relative to fair licensing.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 131 of Chapter 140 of the General Laws, as appearing in the 2010 Official Edition, shall be amended by striking out the first paragraph in subsection (a) in lines 4 through 17 and replacing it with the following:-

A Class A license shall entitle a holder thereof to purchase, rent, lease, borrow, possess and carry: (i) firearms, including large capacity firearms, and feeding devices and ammunition therefor, for all lawful purposes and (ii) rifles and shotguns, including large capacity weapons, and feeding devices and ammunition therefor, for all lawful purposes.

SECTION 2. Section 131 of Chapter 140 of the General Laws, as appearing in the 2010 Official Edition, shall be further amended by striking out the first paragraph in subsection (b) in lines 14 through 26 and replacing it with the following:-

(b) A Class B license shall entitle a holder thereof to purchase, rent, lease, borrow, possess and carry: (i) non-large capacity firearms and feeding devices and ammunition therefor, for all lawful purposes, (ii) rifles and shotguns, including large capacity rifles and shotguns, and feeding devices and ammunition therefor, for all lawful purposes.

A Class B license shall not entitle the holder thereof to carry or possess a loaded firearm in a concealed manner in any public way or place.

A Class B license shall not entitle the holder thereof to possess a large capacity firearm, except under the direct supervision of a holder of a valid Class A license at a shooting club or range.

SECTION 3. Section 131 of Chapter 140 of the General Laws, as appearing in the 2010 Official Edition, shall be further amended by striking out the first paragraph in subsection (d) in lines 98 through 109 and replacing it with the following:-

(d) Any person residing or having a place of business within the jurisdiction of the licensing authority or any law enforcement officer employed by the licensing authority or any person residing in an area of exclusive federal jurisdiction located within a city or town may submit to such licensing authority or the colonel of state police, an application for a Class A or Class B license to carry firearms, or renewal of the same, which such licensing authority or said colonel shall issue if the applicant is not a prohibited person as outlined in (i) through (vii) of this subsection.

SECTION 4. Section 131 of Chapter 140 of the General Laws, as appearing in the 2010 Official Edition, shall be further amended by striking out in subsection (f) in lines 185 through 187 the following:-

“A license may be revoked or suspended by the licensing authority if it appears that the holder is no longer a suitable person to possess such license.”
