Flanagan (with the approval of the mayor and city council) for legislation to grant an additional license for the sale wines and malt beverages in the city of Fitchburg.  Consumer Protection and Professional Licensure.  [Local Approval Received.]

An Act authorizing the city of Fitchburg to grant an additional license for the sale of wines and malt beverages not to be drunk on the premises..

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Section 1. Notwithstanding section 17 of chapter 138 of the General Laws, or any other general law or special law to the contrary, the local licensing authority of the city of Fitchburg may grant an additional license for the sale of wine and malt beverages not to be drunk on the premises pursuant to section 15 of chapter 138 of the General Laws to Ray’s Variety, located at 767 River St., Fitchburg, Massachusetts, upon approval of and under conditions set by the local licensing authority of the said city.  A license granted under this section shall be subject to all of said chapter 138 except section 17.

Section 2. Once issued, the local licensing authority of said city shall not approve the transfer of the license issued under this act to any other location, but it may grant the license to a new applicant at the same location if the applicant files with said local licensing authority a letter from the Massachusetts Department of Revenue indicating that the license is in good standing with said Department and that all applicable taxes have been paid.

Section 3. If the license granted under this act is cancelled, revoked or no longer in use, it shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to said local licensing authority which may then grant the license to a new applicant at the same location under the same conditions as specified in this section.

Section 4. This act shall take effect upon its passage.
