An Act protecting the coastal waters of the commonwealth.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Chapter 21A of the General Laws is hereby amended by inserting the following section:-

Section 14A. No passenger vessel operating within the marine boundaries of the commonwealth, as defined in section 3 of chapter 1, shall dispose of in or discharge into such waters solid waste or macerated sewage of any kind. Any person in violation of this section shall be subject to the civil administrative penalties provided in section 16.

As used in this section, “passenger vessel” shall mean a vessel engaged in the carrying of passengers for hire, but shall not mean: (i) vessels without berths or overnight accommodations for passengers; or (ii) noncommercial vessels, warships, vessels operated by nonprofit entities as determined by the Internal Revenue Service of the United States Department of the Treasury, or vessels operated by commonwealth, the United States, or a foreign government.
