By Representative McMurtry of Dedham and Senator Rush, a joint petition (accompanied by bill, House, No. 3519) of Paul McMurtry and Michael F. An Act authorizing the town of Dedham to grant 3 additional licenses for the sale of all alcoholic beverages to be drunk on the premises.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. (a) Notwithstanding section 17 of chapter 138 of the General Laws, or any other general or special law to the contrary, the town of Dedham may grant 3 additional licenses for the sale of all alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138, subject to the conditions set forth in this act.

(b) The licensing authority shall restrict the licenses granted pursuant to this act to entities located in Dedham Square, as defined in subsection (c).  Licenses issued pursuant to this act shall be nontransferable to any other locations, persons, corporations or organizations.

(c) For the purposes of this act, Dedham Square shall be the geographical area in the town of Dedham consisting of Bryant Street, Eastern Avenue, those portions of Washington Street from Bryant Street to Star Lane, Harris Street, and those portions of High Street from Ames Street to Harvard Street.

(d) Notwithstanding said section 12 of said chapter 138, the additional licenses authorized by this act shall be subject to an original application fee of $5,000.00 more than the annual fee for existing alcoholic beverages licenses in the town of Dedham.  The additional $5,000.00 fee shall be deposited into an economic development account in the town of Dedham and expended consistently with the purposes of such account.

(e) Notwithstanding sections 12 and 77 of said chapter 138, the licensing authority for the town of Dedham may restrict the licenses issued pursuant to this act to holders of common victualler licenses.

(f) A license granted under this act, if cancelled, revoked or no longer in use, shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority for the town of Dedham.  The licensing authority may then grant the license to a new applicant who meets the criteria set forth in this act.

SECTION 2. This act shall take effect upon its passage.
