In the Year Two Thousand Thirteen

An Act relative to pesticide application.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Section 1 of chapter 132B of the General Laws, as appearing in the 2010 Offical Edition, is hereby amended by inserting after the second paragraph the following words: "Nothing herein, nor any regulation issued by the Massachusetts Department of Agricultural Resources, shall preclude any city or town from requiring, prior to any application of pesticide within that city or town, a hearing to determine whether a proposed application of pesticides in particular locations will be consistent with the product’s labeling, other restrictions imposed by the Pesticide Board or its subcommittees, and whether the applicant is proposing to use particular presticides only as permitted by law.”
