An Act relative to the town of Dennis Barrier Beach Protection Stabilization Fund.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Chapter 108 of the Acts of 2011, An Act Establishing a Barrier Beach Protection Stabilization Fund in the Town of Dennis, is hereby amended by deleting section 1 in its entirety and replacing it with the following: Notwithstanding section 53 of chapter 44 of the General Laws or any other general or special law, rule or regulation to the contrary, there shall be in the Town of Dennis a special fund to be known as the Barrier Beach Protection Stabilization Fund. There shall be deposited into the fund, without further appropriation, monies in the amount of 40 per cent of the fees collected by the Town of Dennis from the sale of off road vehicle permits. Appropriations from the fund shall be made by a two-thirds vote of Town Meeting and shall be used exclusively for barrier beach protection, including, permitting, law enforcement and restoration. The percentage amount of the off road vehicle permit fees to be deposited in the fund may from time to time be increased or decreased by a majority vote of a Town Meeting.

SECTION 2. This Act shall take effect upon passage;
