An Act increasing the fine for the illegal taking of eels and elvers.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Section 100D of chapter 130 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by striking out the third paragraph and inserting in place thereof the following paragraph:-

Whoever violates any provision of this section shall be punished by a fine of not less than one hundred dollars or by imprisonment for not more than thirty days, or both; except, whoever violates the immediately preceding paragraph pertaining to the commercial taking of elvers or eels less than six inches in length, shall be punished by a fine of not less than $10,000 or by imprisonment for not more than thirty days, or both.

SECTION 2. Section 100D of said chapter 130, as so appearing, is hereby amended by striking out, in line 7, the word “four” and inserting in place there of the following word:- six.

SECTION 3. Section 52A of chapter 131 of the General Laws, as appearing in the 2012 Official Edition, is hereby amended by striking out the fourth paragraph and inserting in place thereof the following paragraph:-

Whoever violates any provision of this section shall be punished by a fine of not less than one hundred dollars or by imprisonment for not more than thirty days, or both; except, whoever violates the immediately preceding paragraph pertaining to the commercial taking of elvers or eels less than six inches in length, shall be punished by a fine of not less than $10,000 or by imprisonment for not more than thirty days, or both.

SECTION 4. Section 52A of said chapter 131, as so appearing, is hereby amended by striking out, in line 20, the word “four” and inserting in place there of the following word:- six.
