An Act relative to employment benefits for Patricia Kannler.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to provide forthwith certain employment benefits, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

Notwithstanding paragraph (g½) or (g¾) of subdivision (1) of section 4 of chapter 32 of the General Laws, or any other general or special law, rule or regulation to the contrary, the Massachusetts teachers’ retirement board shall allow Patricia Kannler to purchase up to 4 years of creditable service for maternity leave taken prior to 1975; provided, however, that Patricia Kannler shall pay, in 1 sum or installments, an amount equal to the deductions that would have been withheld had she continued in service, as determined by the board, together with buyback interest.

In the event that Patricia Kannler retires before the completion of such payments, the Massachusetts teachers’ retirement board shall, upon completion of such payments, recalculate Patricia Kannler’s retirement benefit to include the period of maternity leave as creditable service. The recalculation of Patricia Kannler’s benefit shall be retroactive to her effective date of retirement.
