By Representative Hogan of Stow and Senator Eldridge, a joint petition (subject to Joint Rule 9) of Kate Hogan and James B. Eldridge (by vote of the town) that the town of Stow be authorized to construct and install any structures, transmission lines, systems and facilities, for the purpose of operating a public water supply, on conservation land.  Environment, Natural Resources and Agriculture.  [Local Approval Received.]

An Act relative to a certain parcel of land in the town of Stow.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.  Notwithstanding the provisions of any general or special law to the contrary, the town of Stow may construct and install, for the sole purpose of operating a public water supply, any structures, transmission lines, systems and facilities necessary to support a public water supply on a certain 17.69 acre parcel of land acquired by the town for conservation purposes. The parcel is identified in a deed to the town of Stow recorded on May 8, 1998 at the Middlesex South registry of deeds at book 28554, page 427, as Parcel A1 as shown on a plan of land entitled “Elizabeth Brook Farm, Stow Massachusetts, Definitive Subdivision Plan, Planned Conservation Development (PCD)”, prepared for Commons Development, Westford, Massachusetts dated December 1996, revised February 20, 1997, Scale 1”=60’, recorded with the Middlesex South registry of deeds as Plan No. 420 of 1997.

SECTION 2. Notwithstanding any general or special law to the contrary and simultaneous with the construction and installation authorized in section 1, the town of Stow shall, pursuant to section 3 of chapter 40 of the General Laws, transfer the care, custody and control of a certain .74-acre parcel of land located in and owned by the town from the board of selectmen to the conservation commission for conservation purposes. The parcel, which abuts the police station on Great road, is identified as parcel 40 on Stow Property Map U-10.

SECTION 3.  This act shall take effect upon its passage.
