An Act authorizing the conveyance of certain land in the city of Holyoke.

 

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to authorize forthwith the conveyance of certain land in the city of Holyoke , therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding any general or special law to the contrary, the commissioner of capital asset management and maintenance may convey to Edward Moriarty, by a deed to be recorded with the Hampden registry of deeds, a .091 acre parcel of land located on Fairmont Street in the city of Holyoke identified as parcel ID 153-00-005 on the city of Holyoke assessor’s online property viewer, being a parcel or section thereof taken by the Commonwealth for the purpose of giving the Soldiers’ Home in Holyoke access to Fairmont Street as described in an order of taking dated November 27, 1951 and recorded with the Hampden Registry of Deeds on page 171 of Book 2150.

SECTION 2. The consideration for the conveyance authorized by section 1 shall be the full and fair market value determined by a professional appraisal commissioned by the commissioner of capital asset management and maintenance.  

The inspector general shall review and approve the appraisal, and the review and appraisal shall include an examination of the methodology utilized for the appraisal. The inspector general shall prepare a report of his review and approval of the appraisal and file said report with the commissioner of capital asset management and maintenance, and copies of the same shall be filed with the house and senate committees on ways and means and with the joint committee on state administration and regulatory oversight.

SECTION 3. Edward Moriarty shall be responsible for all costs associated with any appraisal, survey or other expense incurred by the commonwealth relating to the conveyance authorized by section 1.
