Section 229: The commissioner shall adopt regulations requiring hospitals to offer, prior to discharge, immunizations against the influenza virus to all inpatients 65 years of age and older for each calendar year beginning on October 1st and continuing until March 1st of the following year; provided that, such offer is not contradicted.
The immunization shall be provided based upon the availability of the influenza vaccine at the time of the offer and in accordance with the latest recommendations of the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention.
