An Act providing for the preservation of a memorial to landing ship tanks in the town of Higham.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding sections 32 to 38, inclusive, of chapter 7C of the General Laws or any other general or special law to the contrary, the commissioner of capital asset management and maintenance, in consultation with the department of conservation and recreation, may authorize the assignment by the United States LST Association, Massachusetts Chapter, Inc. (or its successor) to the town of Hingham of a certain existing permanent easement on a portion of land located at the Hingham Shipyard in the town of Hingham for the purpose of maintaining a monument honoring those who served on landing ship tanks, as set forth in and subject to the provisions of chapter 343 of the Acts of 1996 and that certain Grant of Easement, dated December 17, 1999 and filed as Document No. 459441 with the Plymouth County Registry District of the Land Court, and the town of Hingham may accept said assignment of easement.

SECTION 2. In consideration for the assignment of the easement, the town of Hingham shall manage, operate, repair, maintain and replace the monument in said easement area and have access thereto at reasonable times.

SECTION 3. The town of Hingham shall be responsible for all costs and expenses including, but not limited to, costs associated with any engineering, surveys and document preparation related to the grant of easements authorized in section 1 as the costs may be determined by the commissioner.
